Terms and Conditions & Liability Release

Terms & Conditions

By completing you're online registration for The Phat Life Events (hence forth know as "the event" or "retreat") you accept these Terms and Conditions as a binding contract between The Phat Life with Ash Mac (hence forth known as The Phat Life) on behalf of yourself and any other members of your booking. The Phat Life cannot accept your booking without a completed online reservation with payment. A written/emailed confirmation sent to you by Ash Mac/The Phat Life means The Phat Life has accepted your booking.

Payment, Reservation & Deposit
100% of the event price is due at the time of booking, unless otherwise agreed upon in writing. This is taken in good faith and is not refundable due to associated costs such as, but not limited to, the 3rd party services rendered, accomodations, special guests, gifts etc. Once this payment has been paid it secures your reservation. We cannot guarantee any reservation until your payment has been received. Payments are made via paypal or via credit card. Travel, airport transfers, or any additional accommodation are not included in the event price. In the event that an automatic payment arrangement is agreed upon and a payment is missed or declined, you must contact Ash Mac/ the event coordinator immediately to make additional arrangements or you will forfeit your ticket and any monies previously paid is non-refundable.

Cancellations and Refunds
All event purchases and reservations are non-refundable. No exceptions to this policy can be made for any reason, therefore holiday/travel insurance with a cancellation policy to cover any such rare occurrence is strongly recommended.

Rights to Changes
The Phat Life reserves the right to amend the booking dates. This may be due to several reason including, but not limited to, adverse weather conditions, war, riots and/or matters concerning participants safety, acts of God, operational circumstances beyond our control or any other such reason. In the event of these unlikely circumstances the booking may need to be adjusted accordingly. The Phat Life is not liable for any additional costs or losses that may be incurred by the client due to the change of booking. This includes, but is not limited to, any extra hotel reservations or car rentals or the cost of non-refundable airline tickets. Situations may arise which make it necessary for us to alter the normal booking schedule. We advise that your travel insurance covers holiday curtailment.

Where a teacher or facilitator advertised for an event is not able to teach for any reason, we reserve the right to replace them with another teacher or facilitator at anytime.

Service Disclaimer
Ash Mac and The Phat Life Collective (hereby known as Mentor and/or Collective) is not an employee, agent, lawyer, doctor, therapist, psychologist, manager, tech support, public relations, analyst or accountant. Client understands that Mentor has not promised, shall not be obligated to and will not; Give legal, financial,or medical advice, or any other advice beyond mentoring for the client’s own personal growth.

Travel Insurance
The Phat Life recommends that you take out adequate travel insurance, including cover for medical treatment, accidents and repatriation, and holiday cancellation and curtailment. It is your responsibility that you arrange or ensure you have appropriate comprehensive travel insurance. This to include cover for illness, personal injury and travel delay/cancellation. We assume that such a policy is in force before you depart. You should bring the policy with you in case of an emergency.

Photography
We will at times take still and motion photography during the event for our website and promotional material, including adverts, socila media content, etc. By attending the event, you agree to have your photograph taken. If you are sensitive about this, please let the event coordinator know this when you arrive.

Our Responsibility
We are responsible for providing the services listed on our website and/or event, where it is within our control. The Phat Life cannot guarantee that all items listed on our website/event will be functional at all times, however, all endeavors will be made to rectify any problems to the best of our abilities. We reserve the right without prior notice to withdraw any or all parts of the facilities and/or activities available, and to make changes as necessary. Furthermore, it is agreed by you that the owners/operators of the event are not the guardians of any customers safety and they, individually or collectively, cannot be held liable in any way for any occurrence, which might result in illness, injury, death or other damage, loss or theft to the customer, his property, or his family, heirs, or assigns. The liability of The Phat Life is limited to a total of the booking price irrespective of the title/claim.

Mutual Confidentiality Agreement
The Phat Life respects clients privacy and insists the Client respects The Phat Life Collective's Program and Program Participants. Thus, consider this a mutual non-disclosure agreement. Any confidential information shared by program participants or any representative of the company is confidential, proprietary, and belongs solely and exclusively to the participant who discloses it. Parties agree to not disclose, reveal or make use of any confidential information, any transactions, any discussions from inside the course community feed, workshops, zoom calls, direct messaging, accountability app or course content. Client agrees not to use such confidential information in any manner other than in discussion with other Participants during Program. Confidential information includes, but is not limited to, information disclosed in connection with this Agreement, and shall not include information rightfully obtained from a third party. Both parties will keep confidential information in strictest confidence and shall use the best efforts to safeguard the Confidential Information and to protect it against disclosure.

Personal Belongings
Any valuables left at the property are the guests’ sole responsibility and neither The Phat Life, nor the staff , can be held responsible for any loss or damage of personal property.

Liability/Your Health
All event activities are undertaken at your own risk. For your own wellness and safety, you must comply fully with all and any health and safety regulations introduced by The Phat Life. It is your responsibility to ensure that you are medically, mentally and physically fit and able to use our facilities and participate in any of our activities. Customers who have injuries or mental or physical illnesses are advised to seek doctor’s advice prior to attending our retreat. The Phat Life is not liable for any injuries you may contract during an event. If you have any health conditions, including mental health conditions, that may hinder your stay you will need to inform The Phat Life of these.

Lost and Found
At the end of each event, please ensure you have packed all personal belongings safely before leaving the event. Any items forgotten or lost will not be at the responsibility of The Phat Life to recover and return back to you.

Weather Conditions
Weather conditions can be unpredictable, and can change quickly and significantly. The Phat Life cannot be made liable for unpleasant or unsuitable weather conditions and no refunds are made for such conditions.

Construction Work
The Phat Life cannot predict construction plans in the area and therefore cannot be held responsible for any inconvenience. In the event of building works taking place by local authorities, private developers or neighbors, it is important to note that we are not responsible for such work and we are unable to stop such work taking place and we are unable to control the level of noise. We cannot be held responsible for any building works that take place during your retreat. No refunds can be given in the event of nearby construction.

Force Majeure
Means any unusual and unforeseeable circumstances beyond our normal control, which the consequences of could not have been avoided even when exercising all due care. Such circumstances or events include, but are not limited to, war, or threat of war, riot, civil unrest, industrial disputes or strikes, unavoidable technical problems with the location, transport, or closure or congestion of airports, terrorist activity, natural disasters, industrial disasters, fire, theft, flooding and adverse weather conditions, and any other acts of god ourside of our control. In the event of any of the above refunds or compensation payments cannot be made.

Printing, Typing, Terms & Conditions, Calculation Errors and Omissions
The Phat Life reserves the right to correct any printing or typing errors, omissions or calculation mistakes at any time. We also reserve the right to amend our terms and conditions that apply to your booking at any time and without prior notice.

Contract, Complaints and Suggestions
The Phat Life is confident that you will not have any cause for concern during your attendance. However, if you should have any problems during your stay this should first be brought to the attention of the event manager.

If you are not satisfied with the local resolution, then, any further comments or suggestions should be put in writing, within 14 days of your return, specifying the problems to: heyashmac@gmail.com

Agreement of Release and Waiver of Liability

I hereby agree to the following:

As I participate in activities offered by the hosts and special guests, I understand that the offerings of this retreat are not a substitute for medical attention, examination, diagnosis, or treatment.

I may receive fitness related information and instruction. I recognize that all exercise programs require physical exertion that may be strenuous and may cause physical injury and I am fully aware of the risks and hazards.

If at any time during the activities I feel discomfort or pain, I will inform and seek assistance from the teacher and/or event organizer.

I may rest at any time during the class and over the weekend. I will listen to my body and respect its limits on any given day.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any activity program. I represent and warrant that I am physically fit and I have no medical condition that would prevent my participation in fitness classes or workshops.

I recognize that it is my responsibility to notify my teacher of any serious illness or injury before every class.

I accept that neither the instructors, nor the hosting facility, are liable for any injury, or damages, to person or property, resulting from my participation in this reatreat.

Exclusion of Participation: In the unfortunate circumstance, if a guest conceals physical and/or health issues, is unfit, and/or causes disruptions that endanger the provision of the service and/or the health of other participants,facilitators, or equipment the guest can be excluded from the participation of the Retreat after an initial warning. If the situation arises, the contract will be terminated without further notice, already paid costs are non-refundable and incurring costs are to be paid by the guest.

I have read the above release and waiver of liability and fully understand it’s contents as well as any additional terms and conditions/policies. I voluntarily agree to the terms and conditions stated above.
